A sunscreen company that made claims implying rival sunscreens contain chemicals that are “more dangerous than the sun itself” has been found to have abused consumers’ trust.

A complaint to the (Australian) Therapeutic Products Advertising Complaints Resolution Panel raised concerns about an advertisement on the website of Skin Elements that claimed many sunscreens contained “dangerous” chemicals such as oxybenzone and titanium dioxide.

The ad contained phrases such as, “some doctors claim [oxybenzone is] more dangerous than the sun itself” and “oxybenzone can change the way hormones work in our bodies ... that could mean ... something as potentially life-threatening as hormone sensitive cancers like breast, prostate, ovarian cancers”.

The company’s own sunscreen brand, Soleo Organics, was a “safe alternative”, the ad said.

The panel found the claims were “likely to undermine important public health messages” and could cause people to avoid using sunscreens.

Although some of the individual claims about possible harmful effects of particular sunscreen ingredients “could be regarded as extrapolations from some preliminary evidence”, the panel was not satisfied that the claims were supported by enough evidence to warrant their use in advertising, it said.

The ad “abused the trust and exploited the lack of knowledge of consumers, contained language that was likely to cause fear and distress in consumers, made comparisons that were misleading and were not balanced, and contained comparisons that implied that other sunscreens were harmful”, the panel found.

It directed Skin Elements to publish a retraction on their website for a full year, and not make the claims again.
